Myne Terms and conditions

By accessing the Myne website, Myne Web-platform and Myne App and the Service, you confirm that you accept the terms and conditions outlined below (“The Agreement”), and that you agree to be bound by them. The Service is owned and operated by MYNE TECH LTD.

These terms and conditions together with our Privacy Policy list the terms on which you may use the Service, your rights and responsibilities to us, and our rights and responsibilities to you. Please read the Agreement carefully before proceeding to use the Service, and if possible, print or save a copy of the Agreement.

  1. Who We Are and How to Contact Us
    1. Myne Website, Myne App and Myne Web-platfrom are owned and operated by MYNE tech LTD , a private company registered in Dubai, United Arab Emirates with license number CL7367 and whose registered office is at Unit 02, Level 07, Dubai Gate Village, DIFC, United Arab Emitates

  2. Applicable Terms and Consent
    1. By accessing or using Myne’s services, you confirm that you accept and will comply with these Terms and Conditions and all other terms set out in the Agreement. If you do not agree with these Terms and Conditions or any other terms in the Agreement, you cannot use any of Myne’s services. Additionally, to use the services, you must be at least (i) 18 years old or (ii) the age of majority where you live. Individuals under these age limits are not permitted to use the services, provide Personal Data, or otherwise submit Personal Data through the services.
    2. If you use the services on behalf of someone else, whether an individual or a legal entity, you confirm that you are legally authorized to agree to (i) this Agreement on their behalf and (ii) use the services for them. Additionally, you acknowledge that you will indemnify Myne and its affiliates against any breach of these representations.
    3. For more information about our policies, please refer to the privacy policy on Myne Website.
    4. We reserve the right to change, amend, or modify the Agreement at any time at our sole discretion by posting such changes on the website and/or the Myne app, with or without notice.
    5. You are responsible for regularly reviewing information posted online to stay informed of changes. We recommend you regularly check the website and the Myne app to stay updated on the current terms. We do not guarantee that our website or app will always be up to date, nor will we be liable for inaccurate or outdated content. Continuing to use the services after changes are posted means you accept the modified Agreement.
    6. If there is a conflict between these Terms and Conditions and any specific terms in the Agreement, the specific terms will prevail.
  3. Your Account
    1. To access and use the Myne app, you’ll need to create an account. You must provide accurate and complete information as prompted during registration. We may take measures to verify your identity, and you authorize us to make any inquiries we consider necessary to confirm your identity. This may include (i) asking for additional information, (ii) asking you to confirm your email or financial details, or (iii) cross-referencing your information with third-party databases or other sources. If you don’t provide the requested information or we can’t verify your identity, we reserve the right to prevent you from using our services.
    2. We may enable you to log into the service via third-party platforms, like Google or Apple (“Third-Party Services”). To use these features, you might need to authenticate, register, or log into Third-Party Services through their websites. These services may share certain information you provided to them, which we will use, store, and disclose according to our Data Privacy Policy, available on the Myne Website.
    3. Third-Party Services store and disclose your information according to their own policies. We aren’t responsible or liable for their privacy practices or any other actions. Similarly, we aren’t responsible for any loss or damage from using or relying on any Third-Party Services.
    4. You confirm that you are the owner of the email address provided in connection with the service. You agree that Myne Tech LTD and its affiliates may contact you via this email address to verify your identity, provide notices, fulfill requests, resolve complaints, or provide promotional information. However, for promotional and other non-essential information, you can opt out at any time using the steps outlined in the emails we send. We aren’t liable for delayed or undelivered emails.
    5. You agree to receive all notices and information via the email address you provided. It’s your responsibility to provide accurate contact information and update us if it changes. If we discover any information is false or inaccurate, we may suspend or terminate your account at any time.
    6. You are responsible for keeping your account secure. Notify us immediately at info@joinmyne.com if you suspect any loss or unauthorized use of your account or password. We don’t take responsibility for any losses that result from unauthorized use of your account.
    7. Data transmission over the internet, including email, isn’t fully secure and may lead to loss, interception, or alteration. We aren’t responsible for any losses or costs you incur from such transmissions. We will protect your data according to our Data Privacy Policy, but won’t be liable for unauthorized access by third parties.
    8. If you wish to close your account and disable access to the service, you can delete the account on the app or contact us at info@joinmyne.com For more information on data removal, see the Data Privacy Policy.
    9. If you want to remove Myne Tech LTD from your devices, deleting the app will only remove the data from the device. Your content will remain subject to this agreement and relevant laws.
  4. The Service:
    Myne service is provided by 4 distinct verticals explained below :

    Myne allows you to connect your banking assets (Financial accounts) and non-banking assets like property and luxury assets in 1 single dashboard.it provides you a live view of your networth anytime in any currecny – to give you clearer insights into your finances (the”Service vertical 1). on top fo that it gives you live expenses monitoring , budgeting tool to create gaols and view transactions (the”Service vertical 2). More over Myne will soon will give you access to an investment marketplace where you can view and learn more about investment opportunities (the”Service vertical 3), and lastly Myne gives you access to top tier estate / wealth planners that will help you safegaurd your wealth with digitized estate planning services such as wills, POA’s, foundations among many others (the”Service vertical 4),

  5. Connecting Personal Accounts:

    We rely on our Trusted Partners, Lean Tech Inc. (“Lean”), Flanks Inc. (“Flanks”), and Vezgo Inc. (“Vezgo”) for the provision of the Service of connecting your bank accounts , stock and crypto wallets. We also rely on Polygon lts (“Polygon”) to connect to the live stock and crypto market prices allowing you to see your positions in real time and visualize growth vs your initial positions. (You can find out more information about these partners on their respective websites).

    For the provision of the Service, you give your consent to provide your Personal Account login details to our Trusted Partner, who will then automatically download your personal account information securely through their proprietary APIs. Our Trusted Partner will continue to do so until you withdraw your consent.

    By agreeing to the terms and conditions you grant to us and our Trusted Partner a royalty-free and non-exclusive license to the information in your personal accounts for the provision of the Service, which is visualised in a dashboard on the website.

    You agree that we will be entitled to disclose your identity and information relating to your Personal Account(s) to third parties if we are required to do so by any applicable law or court order. By using the Service, you confirm that you are the legal owner of all the personal information in your Personal Accounts and that you have the authority to appoint, and do appoint, our Trusted Partner as your agent and grant a limited power of attorney to access and retrieve such information on your behalf.‍

  6. Privacy & Cookies:‍
    Your privacy and security is of high importance to us. Myne’s Privacy Policy explains how we store and process your data and protect your privacy when you use our service.We use cookies for enhancing your user experience when you use our ServiceBy using our Service, you agree to the terms of our Privacy policy which forms part of our Agreement with you. You can read this on our Privacy page.
  7. Your Use of the Service:
    You agree to ensure that you access the Service as permitted by law, and do not interfere with or damage (including attempting to do the same) our Service by using a method not listed in the terms of the Agreement. You may access the service from a third-party web browser (such as Chrome, Safari, Edge, Firefox) and must not attempt to use any engine, software, tool or mechanism (including but not limited to spiders, crawlers, bots, scrapers) to navigate the Service.

    You must not alter or modify (including attempting to do the same) the visualised dashboard after the provision of the Service in any way or form, including but not limited to altering the content and the code. You must not inaccurately imply any associations with the Service and Myne. You must not transmit any file, including but not limited to, viruses, worms, trojan horses, or any other malware to interfere with the provision of the Service.

    Please do not provide any unsolicited information regarding the Service to Myne unless explicitly requested by Myne with proper feedback gathering mechanisms. You agree that such unsolicited information may be used in the development of the Service and other areas deemed necessary by us without any liability or payment to you.‍

  8. Third-Parties:
    For the provision of the Service, we may use Third-Party websites, applications or features (“Third-Party Services”). We do not control Third-Party Services and you acknowledge and agree that your use of Third-Part Services is at your own riskWe assume to liability for the operation of Third-Party Services, and will be not liable for any loss or damage that arises from such use of Third-Party Services.‍
  9. Suspension and Termination
    1. We reserve the right to refuse to provide the Services to anyone, and can monitor, terminate, or suspend your account or access to the Services at any time.
    2. We may, in our sole discretion, also deactivate, terminate or suspend your account or access to any and all Services at any time.
      1. if we determine you are or have been in violation of the Agreement or applicable law
      2. in response to requests by law enforcement or other applicable authority,
      3. upon discontinuation or material modification of any Services
  10. Privacy
    1. We will process your Personal Data in accordance with our Data Privacy Policy, which may be amended from time to time. You have a number of rights which relate to access and control over your Personal Data, which are set out in the Data Privacy Policy available on the Myne App.
    2. You acknowledge and agree that we may, in our sole and absolute discretion, combine information you enter or upload for the Services with that of other Users and/or other Services to the extent permitted by applicable law. For instance, we may use non-identifiable, aggregated data of Users to improve the Services or to design promotions. Further, you acknowledge and agree that we may, in our sole and absolute discretion, access or store personal information in multiple countries, including countries outside of your own country, in accordance with applicable law.
  11. Warranties:

    You agree that your use of the Service and content (including that of third parties) included in or accessible from the Service is at your own risk. You agree that the service is provided on an”as is” and”as available” basis.Myne and its Trusted Partners disclaim all warranties of any kind as to the Service and content (including that of third parties) included in or accessible from the Service.

    We and our Trusted Partner make no warranties that the Service will meet your requirements; the Service will be uninterrupted, timely, secure, or error-free; the results that may be obtained from the use of the Service will be accurate or reliable; the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations; or any errors in the technology will be corrected.‍

  12. Our Liability:
    Myne
    is not developed to meet your individual needs, it is your responsibility to ensure that it meet such requirements. Myne provides the Service for domestic and private use. You may not use the Service for any commercial, business, or resale purposes and we have no liability to you for any loss of profit, loss of revenue, loss of business, business interruption, or loss of business opportunity.

    All information and content made available through the Service is not financial advice, and Myne is not a Financial Advisor. You are responsible for making your own decisions by using your own judgement and seeking professional advice.

    We and our Trusted Partners do not in any way limit our liability for: Fraud and fraudulent activities; Loss of profits and goodwill; any statement or conduct on or via the Service by any third party; loss of data which is caused by factors other than negligence or breach of statutory duty on the party of us or our Trusted Partner; the acts or omissions of the providers of your Personal Account(s);the cost to you of obtaining goods or services as substitutes for the Service; or any other loss or damage suffered by you in connection with the Service.‍

  13. Indemnification:
    You agree to protect and fully compensate our Trusted Partner and us and our affiliates from any and all third party claims, liability, damages, expenses and costs (including, but not limited to, reasonable solicitors’ fees) caused by or arising from your use of the Service, your violation of these Terms or your infringement, or infringement by any other user of your account, of any intellectual property or other right of anyone.‍
  14. Changes to the Agreement:
    We may change the terms of this agreement at any time, and all such changes will be posted on our website. Some reasons to make changes to the Agreement may include but not limited to; introducing new services; withdrawing some services; account for developments in technology, security & industry norms; and change in legislation.

    The date on the Agreement states the time of the last revision to the terms of the agreement. You hold the right to stop using the Service if you do not agree with any changes to the terms of the Agreement.‍

  15. Terminating the Agreement:
    We may at any time terminate the Agreement with you: if you breach any of the terms of this Agreement; if you act in a manner inconsistent with the terms of the provision of the Service; if we in our sole discretion believe we are required to do so by law. You may at any time terminate the Agreement with us by sending us an email to hello@Myne.app with your details.‍
  16. App Store
    The following applies to any App Store Sourced Application accessed through or downloaded from mobile app stores:
    1. You acknowledge and agree that (i) the Agreement is between you and Myne only, not the app store provider (“App Store Provider”), and (ii) Myne is solely responsible for the App Store Sourced Application and its content. Your use of the App Store Sourced Application must comply with the relevant App Store Terms of Service.
    2. You acknowledge that the App Store Provider has no obligation to provide maintenance or support services for the App Store Sourced Application.
    3. If the App Store Sourced Application doesn’t meet any applicable warranty, you may notify the App Store Provider, and they may refund you the purchase price for the application, if permitted by law. The App Store Provider will have no further warranty obligations regarding the App Store Sourced Application.
    4. You and Myne acknowledge that, between Myne and the App Store Provider, the App Store Provider isn’t responsible for handling any claims you or a third party have regarding the App Store Sourced Application, including but not limited to: (i) product liability claims; (ii) claims that the App Store Sourced Application doesn’t comply with any legal or regulatory requirements; and (iii) claims under consumer protection or similar legislation.
    5. You and Myne acknowledge that if a third party claims that the App Store Sourced Application, or your possession and use of it, infringes their intellectual property rights, Myne, not the App Store Provider, will be responsible for investigating, defending, settling, and addressing any such intellectual property infringement claim as required by the Agreement.
    6. You and Myne agree that the App Store Provider and its subsidiaries are third-party beneficiaries of the Agreement as it relates to your license of the App Store Sourced Application. When you accept the Agreement, the App Store Provider has the right to enforce the Agreement regarding your license of the App Store Sourced Application against you.
  17. Governing Law and Arbitration
    1. This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales
    2. Any dispute arising out of the formation, performance, interpretation, nullification, termination or invalidation of this contract or arising therefrom or related thereto in any manner whatsoever, shall be settled by arbitration at the premises of the Dubai International Arbitration Center in accordance with the provisions set forth under the Rules of Commercial Conciliation and Arbitration (“Rules”) of the Dubai Chamber of Commerce & Industry, by three arbitrators appointed in compliance with the Rules.
  18. Entire Agreement
    This Agreement and any documents explicitly referred to in this Agreement, are the entire agreement between you and us.
  19. Severability, No Waiver, and Survival
    If any part of this Agreement is held invalid or unenforceable, that portion of the Agreement will be construed to reflect the parties’ original intent. The remaining portions will remain in full force and effect. Any failure on the part of Myne to enforce any provision of this Agreement will not be considered a waiver of our right to enforce such provision. Our rights under this Agreement will survive any termination of this Agreement.
